Reuniting Couples Within The United States Through Fiancé Visas

Specific requirements exist to secure a fiancé visa:

  • The petitioner is a U.S. citizen.
  • Both petitioner and fiancé intend to be physically present for marriage within 90 days of the fiancé entering the United States. No ceremony within that time frame will result in an expiration of status without an extension.
  • Both are free to marry and any previous marriages have been terminated legally by divorce, death or annulment.
  • Both have met in person at least within two years of filing the petition (this sometimes requires photographic evidence).
  • Both must submit to individual interviews.

Exceptions exist that would require a waiver:

  • The requirement to meet before the ceremony violates longstanding and strict customs of foreign culture or social practice.
  • The initial meeting would lead to extreme hardship.
